Terms of service.
The agreement between you and HARD, in plain English. Please read it before you use the apps or pay for a plan.

About these terms
These terms are an agreement between you and FLINDEV PTY LTD, trading as HARD (“HARD”, “we”, “us”). They cover hard.fyi, HARD for Mac, HARD for iPhone, the HARD browser extension, and our paid plans: Personal, Family, Business and HARD Operator. By using HARD, you agree to them. If you use HARD for an organisation, you agree for it, and confirm you can.
Our privacy policy explains what we collect and why. It’s part of these terms.
What HARD is
HARD is security software. On your Mac, iPhone and browser, it looks for scams, fake sites, risky software and weaknesses on your network, warns you, and in some cases steps in: for example, by blocking a site or pausing a payment while you think. HARD Operator adds people: a named senior engineer for your household, who also secures each home’s network.
What each plan includes is described on our pricing page at the time you sign up.
Early access
HARD is in early access. That means:
- Some features are still being finished, and may change, be withdrawn, or not work as described. Where something isn’t ready, our docs say so.
- We let people in as places become available. Joining the list doesn’t guarantee a place.
- The terms of your early access place, including price, when billing starts, cancelling and refunds, are confirmed when your place is ready, before you pay.
Please don’t rely on HARD as your only protection while it’s in early access.
Your account
You need to be 18 or over to hold a plan, and to give us accurate details. You’re responsible for the devices you install HARD on, for keeping them and your account secure, and for what happens through your account. Tell us straight away if you think someone else is using it.
We will never ask for your passwords, one-time codes or recovery keys. Don’t give them to anyone who says they’re from HARD.
Family and managed accounts
On the Family plan, an organiser can add up to six people and manage HARD for someone they look after. If you’re an organiser, you’re responsible for the people you add, and you agree that:
- you’ll only add someone, or manage their HARD, with their agreement, or, for a child, as their parent or guardian;
- you’ll set up a managed account with the person, on their devices, and tell them what you’ll be able to see;
- you’ll stop managing someone’s HARD if they ask you to, and remove them from the plan if they want to leave;
- you’ll use what you see only to protect them.
A managed account shows the organiser important alerts and what needs fixing, not the person’s messages, browsing or bank balance.
Using HARD properly
HARD is for protecting yourself, your family, your organisation and the devices you’re responsible for. You must not use it to:
- monitor, track or watch another person without their knowledge and agreement, or in breach of any law;
- scan, test or interfere with networks or devices you don’t own or don’t have permission to check;
- break the law, or help anyone else to;
- attack, overload, reverse engineer or get around the security of HARD or its services, except as allowed by law or our security policy;
- resell HARD, or use it to build a competing product.
If you do, we may suspend or end your access.
HARD Operator
HARD Operator is offered by introduction. Its services (discovery, the written report, fixes, your engineer, securing each home’s network, monitoring, concierge, privacy work and recovery) are set out in a separate agreement with your household or company, including the scope, how to reach your engineer, and any NDA. If that agreement and these terms differ, the agreement wins.
To do their work, your engineer may need access to your accounts and devices. They act only on your instructions and within the agreed scope, and they will never ask you for a password over the phone or by message. Some work, like recovering an account or money, depends on third parties such as banks and platforms, and we can’t guarantee the outcome.
Payments, cancelling and refunds
- Prices are in US dollars and shown on our pricing page. Personal and Family are priced per month and billed yearly. Business is priced per person. HARD Operator is billed monthly or yearly.
- Early access terms, including how you pay, when billing starts, renewal, cancelling and refunds, will be confirmed when your place is ready. You’ll see them before you pay, and they form part of these terms.
- If we change the price of your plan, we’ll tell you before it renews, and you can cancel before the new price applies.
- Taxes may apply depending on where you are.
Nothing in this section limits your rights under the Australian Consumer Law, or the consumer law where you live, including to a refund for a major failure.
Other services
Some features rely on other companies’ services, such as Anthropic for the Operator chat and the optional second opinion, Cloudflare for Secure DNS, Apple for the iPhone app, and public lists of phishing sites and security flaws. Their terms apply to your use of them. We aren’t responsible for their availability or accuracy, and a feature may stop working if a service changes.
Our software and content
We give you a personal, non-exclusive, non-transferable licence to use the HARD apps and extension on devices you own or control, for as long as your plan or early access place lasts. HARD, its software, its name and this site belong to us or our licensors.
You may share links to our journal, alerts and advisories. If you send us feedback, we may use it without owing you anything.
What HARD can’t promise
HARD makes attacks much harder and catches many scams, but no security product can stop every attack, every scam or every loss. In particular:
- HARD may miss a threat, or warn about something that’s safe. Its verdicts and advice are guidance, not a guarantee.
- You decide what to do, including whether to send money. A pause or a warning doesn’t make a payment safe or unsafe.
- HARD relies on public lists and services that can be incomplete, wrong or unavailable.
- HARD isn’t a substitute for your bank, the police, a lawyer or emergency services. If money has been taken, contact your bank straight away.
To the extent the law allows, HARD is provided as it is and as available, without promises beyond those in these terms.
Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done, you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.
Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law or any other law that can’t be excluded, including consumer law where you live.
Limits on liability
Subject to the section above, and to the extent the law allows:
- we aren’t liable for losses caused by someone else’s attack, scam or fraud that HARD didn’t stop, or for indirect or consequential losses, such as lost profits, savings or data;
- where our liability for a failure to meet a consumer guarantee can be limited, it is limited to supplying the services again or paying the cost of having them supplied again;
- otherwise, our total liability to you is limited to the amount you paid us for HARD in the 12 months before the claim.
Nothing limits liability for our fraud, or for anything else that can’t be limited by law.
Ending the service
You can stop using HARD at any time, and uninstall it as described in our docs. We may suspend or end your access if you break these terms, if the law requires it, or if we stop offering HARD or a feature. If we end a paid plan for a reason that isn’t your fault, we’ll refund the unused part.
Governing law
These terms are governed by the law of New South Wales, Australia, and you and we agree to the non-exclusive jurisdiction of its courts. If you’re a consumer living elsewhere, you also keep the protection of the mandatory laws of where you live, and you can bring a claim in your local courts.
Changes
We may update these terms as HARD changes. We’ll change the date at the top, and if a change matters to you, we’ll tell you before it takes effect. If you don’t agree, you can stop using HARD and cancel your plan before the change applies.
